This website and online store (the "Site") is operated by LAITERIE, a California corporation ("Laiterie," "we," "us," or "our"). Laiterie offers this Site, including all information, tools, products, and services available from this Site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our Site and/or purchasing something from us, you agree to be bound by the following terms and conditions ("Terms of Service" or "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the Site, including without limitation users who are browsers, customers, and contributors of content.

Please read these Terms carefully before accessing or using our Site. By accessing or using any part of the Site, you agree to be bound by these Terms. If you do not agree to all of the terms and conditions of this agreement, you may not access the Site or use any of its services.

Any new features or tools added to the Site shall also be subject to these Terms. You can review the most current version of these Terms at any time on this page.

Our Site is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you.

Eligibility and Account

By agreeing to these Terms, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. The Site is not directed to, and may not be used by, individuals under 18. If you are a parent or guardian purchasing on behalf of a minor in your household, you do so in your own name and are solely responsible for the transaction and any related use of the Site or product.

To make purchases through the Site, you may be required to create an account and provide your name, email address, and billing, payment, and shipping information. You represent and warrant that all information you provide is current, complete, and accurate, and that you have all rights necessary to provide such information.

You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any other person. Please contact us immediately at hello@laiteriehome.com if you become aware of any unauthorized access to your account.

Our Products

We have made every effort to display as accurately as possible the colors, textures, and images of our products as they appear on the Site. However, we cannot guarantee that your device's display of any color or material will be accurate. Product appearance, including fabric texture and sheen, may differ slightly from on-screen representations.

All descriptions of products are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and to limit the quantities of any products we offer to any person, geographic region, or jurisdiction on a case-by-case basis.

We do not warrant that the quality of any products purchased by you will meet your expectations or be identical to how they are depicted on the Site.

Orders

When you place an order through the Site, you are making an offer to purchase. Our acknowledgment that we have received your order — including any "order confirmation" or similar email — does not constitute acceptance of your order. Laiterie reserves the right to accept or decline your order for any reason at its sole discretion. Your order is accepted only when we ship the ordered product(s) to you, at which point a binding contract of sale is formed. Until shipment, Laiterie may modify, limit, or cancel your order, including for pricing or descriptive errors, suspected fraud, or limitations on available quantities. We must receive and process your payment before we will ship your order.

Please review your order carefully before submitting. Once an order has been accepted (shipped), we may be unable to accommodate cancellation requests. In the event we do not accept, modify, or cancel an order, we will attempt to notify you using the contact information provided at the time the order was placed.

You represent and warrant that your purchases are for personal or household use only and not for commercial resale or export. We reserve the right to limit or refuse orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

Returns and exchanges are subject solely to our Refund Policy

Pricing and Billing

Prices are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation. Unless otherwise expressly stated, posted prices do not include applicable taxes, shipping, or handling charges.

You agree to provide current, complete, and accurate purchase and payment information for all purchases. You represent and warrant that: (i) the payment information you provide is true, correct, and complete; (ii) you are duly authorized to use such payment method; and (iii) charges incurred by you will be honored by your payment provider.

We reserve the right to correct any pricing errors, even after an order has been submitted. If a pricing error affects your order, we will notify you and give you the option to proceed at the correct price or cancel your order.

Shipping and Delivery

Domestic Shipping (United States)

Laiterie currently ships within the United States. All delivery times are estimates only and are not guaranteed. We are not liable for shipping or delivery delays caused by carriers, weather, customs processing, or other events outside our control. Once we transfer your order to the carrier, title and risk of loss pass to you. For full details on processing times, delivery windows, shipping rates, and P.O. box restrictions, please visit our Shipping & Delivery page. Non-delivery, lost shipment, and product damage claims are subject to the procedures, requirements, and deadlines set forth in our Shipping & Delivery Policy. Claims submitted after the applicable deadline may not be accommodated, and Laiterie has no obligation to replace or refund late-reported claims.

International Shipping — By Request

Laiterie does not offer standard international shipping at this time. International shipments may be accommodated on an individual, case-by-case basis upon direct request to hello@laiteriehome.com. If we agree to fulfill an international order, the following additional terms apply:

  • Title and risk of loss transfer to you at the time of handoff to the carrier at our shipping facility.
  • Any applicable customs duties, import taxes, or other charges imposed by the destination country are solely your responsibility. We are unable to predict or control such charges.
  • Laiterie makes no representation that products offered on the Site are appropriate or available for purchase in locations outside the United States.

By requesting international fulfillment, you acknowledge and accept these additional conditions.

Returns and Exchanges

All returns and exchanges are governed exclusively by our Refund Policy. Please review the Refund Policy before placing your order, as it forms part of these Terms by reference.

Intellectual Property

The Site and all of its content — including but not limited to the Laiterie name, logo, brand name combinations, trademarks, trade dress, product names, slogans, designs, text, images, photographs, graphics, audio, video, and the selection and arrangement thereof — are owned by Laiterie, its affiliates, or its licensors, and are protected under United States and international copyright, trademark, and other intellectual property laws. The LAITERIE word mark is the subject of a pending U.S. trademark application owned by Laiterie in International Class 24.

These Terms permit you to access and use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Site without our prior written consent. Without limiting the foregoing, no content from the Site (including text, images, product photography, product descriptions, designs, or any portion thereof) may be accessed, scraped, copied, or used to develop, train, fine-tune, evaluate, benchmark, or otherwise input into any machine learning model, generative AI system, large language model, or similar technology, whether for commercial or non-commercial purposes, without Laiterie's prior express written consent.

Nothing in these Terms grants or shall be construed as granting any license or right to use any Laiterie trademark, brand name, logo, or other intellectual property without our prior written permission. All rights not expressly granted herein are reserved by Laiterie.

User Content and Social Media

Discovery and Outreach. From time to time, Laiterie may discover content you have posted publicly on social media that tags or references Laiterie (including through the hashtag #LaiterieHome). Tagging Laiterie or using the hashtag does not by itself grant Laiterie any license to your content. If we are interested in featuring your content, we will contact you directly (by direct message, comment reply, or email) to request your permission and to provide a link to these terms.

License Grant by Explicit Consent. If, in response to our outreach, you reply in writing (including via direct message, comment reply, or email) with a clear affirmative consent statement such as "Yes, you may use this content per Laiterie's UGC terms," you grant Laiterie a worldwide, perpetual, irrevocable (subject to the Revocation paragraph below), royalty-free, non-exclusive, sublicensable, and transferable license to use, reproduce, distribute, publicly display, publicly perform, edit, modify, adapt, create derivative works of, and otherwise exploit your User Content — including in paid and unpaid marketing — on Laiterie's website, social media channels, email and SMS marketing, paid advertising (including on Meta, Google, TikTok, Pinterest, and similar platforms), retail and trade materials, packaging, and other promotional and commercial uses, in any medium now known or later developed. You further grant Laiterie the right to use your name, social media handle, voice, and likeness in connection with such uses, including any rights of publicity arising under California Civil Code §3344 and any similar laws of other jurisdictions. "User Content" means the photographs, images, videos, captions, comments, reviews, or other content that you consented to allow Laiterie to use.

Your Representations and Warranties. By granting the license above, you represent and warrant that: (i) you are at least 18 years of age; (ii) you own all rights in the User Content or have obtained all licenses, consents, and permissions necessary to grant Laiterie the rights described above; (iii) any individual whose name, likeness, voice, or image appears in the User Content is at least 18 years of age and has given you their permission to grant these rights on their behalf; (iv) the User Content does not infringe or violate the intellectual property rights, privacy rights, publicity rights, contractual rights, or any other rights of any third party, and does not contain false, misleading, defamatory, obscene, or unlawful material; and (v) the User Content does not contain viruses, malware, or harmful code. You may not submit, and Laiterie will not knowingly use, any User Content depicting an individual under 18. If you become aware that submitted User Content depicts a minor, you must notify us immediately at hello@laiteriehome.com.

Revocation. You may withdraw your consent for future uses of your User Content at any time by sending written notice to hello@laiteriehome.com. To be valid, your notice must identify the specific User Content you wish Laiterie to discontinue using, by URL, image or video description, date of submission, or other information sufficient to permit Laiterie to identify the content. Upon receipt of a valid revocation notice, Laiterie will use commercially reasonable efforts to discontinue new uses of the identified User Content on Laiterie-Controlled Channels within a reasonable period. "Laiterie-Controlled Channels" means laiteriehome.com, Laiterie-sent email and SMS marketing communications, and Laiterie's active paid advertising campaigns. Revocation does not apply to, and Laiterie has no obligation to remove, recall, or take down: (i) User Content already used, distributed, or queued for use prior to receipt of your notice, including content already incorporated into paid advertising, printed materials, packaging, or archived posts; (ii) organic social media posts already published by Laiterie or by third parties; (iii) content syndicated to retail or trade partners; (iv) third-party press features, affiliate content, or content cached, republished, reposted, or otherwise shared by third parties; or (v) any User Content that you have not specifically identified in your revocation notice. Laiterie has no obligation to monitor for, search for, or proactively identify User Content that is the subject of a revocation request.

Monitoring and Removal
Laiterie has no obligation to monitor User Content but reserves the right, in its sole discretion and without prior notice, to remove or refuse any User Content for any reason. We take no responsibility for and assume no liability for any User Content posted by you or any third party.

SMS / Text Message Program

If you opt in to receive text messages from Laiterie (the "SMS Program"), the following terms apply. By providing your mobile number and submitting your consent through our website, checkout, or other Laiterie-authorized opt-in channel, you provide your prior express written consent under the federal Telephone Consumer Protection Act (TCPA), 47 U.S.C. §227, and applicable state law to receive recurring automated marketing and transactional text messages from Laiterie at the mobile number you provided, including messages sent using an automatic telephone dialing system or pre-recorded voice.

Consent Is Not a Condition of Purchase. Your consent to receive SMS messages is not a condition of purchasing any product or service from Laiterie.

Message Frequency. Message frequency will vary, but we do not expect to send more than eight (8) messages per month unless otherwise disclosed at the time you opt in.

Message and Data Rates. Message and data rates may apply depending on your mobile carrier and plan. Laiterie is not responsible for these charges.

How to Opt Out. You may opt out of the SMS Program at any time by replying STOP to any message from us. After you send STOP, we will send a single confirmation message and no further marketing or promotional messages will be sent. You may continue to receive transactional messages directly related to an order (e.g., shipping confirmations) until you contact us at hello@laiteriehome.com to discontinue those as well.

How to Get Help. For help, reply HELP to any message or email us at hello@laiteriehome.com.

Carrier Disclaimer. Carriers (including AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, MetroPCS, and others) are not liable for delayed or undelivered messages. Not all carriers may be supported.

Privacy. Laiterie does not share your SMS opt-in data or consent records with any third party for that third party's own marketing purposes. SMS communications are otherwise governed by our Privacy Policy.

Third-party Links and Tools

The Site may contain links to third-party websites or provide access to third-party tools. We are not responsible for examining or evaluating the content, accuracy, or practices of any third-party websites or tools, and we do not warrant and will have no liability or responsibility for any third-party materials, websites, products, or services.

Access to any third-party tools is provided "as is" and "as available," without any warranties or endorsement by Laiterie. Your use of any third-party tools is entirely at your own risk. Complaints or questions regarding third-party products or services should be directed to the relevant third party.

Prohibited Uses

You may use the Site for lawful purposes only. You may not use the Site or its content:

  1. For any unlawful or fraudulent purpose;
  2. To violate any applicable international, federal, state, or local laws or regulations;
  3. To infringe upon or violate Laiterie's intellectual property rights or those of any third party;
  4. To harass, abuse, defame, intimidate, or discriminate against any person on any basis;
  5. To transmit false or misleading information;
  6. To upload or transmit viruses, malware, or any other destructive code;
  7. To collect or track the personal information of others;
  8. To spam, phish, scrape, or use automated tools (including AI agents) to access the Site without authorization;
  9. To access, scrape, copy, or use any content from the Site to train, fine-tune, evaluate, benchmark, or develop any machine learning model, generative AI system, large language model, or similar technology;
  10. To purchase products in bulk or for resale, including through coordinated or automated ordering, account farming, or use of bots to circumvent purchase limits;
  11. To reproduce, resell, or commercially exploit any portion of the Site without our express written permission; or
  12. To interfere with or circumvent the security features of the Site.

We reserve the right to suspend or terminate your account and access to the Site at any time, without notice, for any violation of these Terms.

Privacy

All personal information we collect through the Site is governed by our Privacy Policy. By using the Site, you acknowledge that you have read and understood our Privacy Policy. Because the Site is hosted by Shopify, Shopify also collects and processes certain information about your use of the Site in accordance with Shopify's Privacy Policy.

Errors, Inaccuracies, and Omissions

The Site may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders, at any time without prior notice, including after an order has been submitted.

Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED BY LAITERIE, THE SITE AND ALL PRODUCTS AND SERVICES OFFERED THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU IN FULL.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LAITERIE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCTS PROCURED THROUGH THE SITE.

TO THE FULLEST EXTENT PERMITTED BY LAW, LAITERIE'S MAXIMUM AGGREGATE LIABILITY TO YOU ARISING OUT OF OR RELATED TO (A) ANY PRODUCTS PURCHASED THROUGH THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SUCH PRODUCTS; AND (B) ACCESS OR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID TO US IN THE ONE (1) MONTH PERIOD IMMEDIATELY PRECEDING THE DATE ON WHICH YOUR CLAIM AROSE.

Without limiting the foregoing, Laiterie shall not be liable for any damages caused by the acts, omissions, or failures of any third-party shipping carrier, fulfillment provider, or payment processor, including without limitation lost or delayed shipments, damage in transit after handoff to the carrier, and payment processing errors. Your sole recourse for such matters is against the relevant third party in accordance with that third party's terms and applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless Laiterie and its officers, directors, employees, affiliates, agents, contractors, licensors, and service providers from and against any losses, damages, liabilities, claims, and expenses (including reasonable attorneys' fees) made by any third party due to or arising out of: (1) your breach of these Terms or the documents they incorporate by reference; (2) your violation of any applicable law or the rights of a third party; or (3) your access to and use of the Site. The foregoing indemnification obligation will not apply to the extent any loss, damage, liability, claim, or expense arises from Laiterie's gross negligence or willful misconduct.

We will notify you of any indemnifiable claim, and you agree to cooperate in the defense of any such claim. Laiterie reserves the right to assume exclusive control of the defense and settlement of any matter subject to indemnification, at your expense.

Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

In Plain English. If you have a dispute with Laiterie, you first agree to contact us and try to resolve it informally for sixty (60) days. If we cannot resolve it, the dispute will be handled by a neutral arbitrator under the American Arbitration Association's Consumer Arbitration Rules, instead of in court. You also agree not to participate in any class action against Laiterie. You may still take qualifying disputes to small claims court if you prefer. The full legal terms are below.

Governing Law. These Terms and any dispute arising out of or related to these Terms, the Site, or any products purchased through the Site shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Informal Dispute Resolution. Before initiating any arbitration or court proceeding (other than a small claims action), the complaining party must first send a written notice of dispute to the other party. Notices to Laiterie must be sent to legal@laiteriehome.com (or such other address as Laiterie may designate from time to time) with the subject line "Notice of Dispute" and must include the sender's name, contact information, account or order number (if applicable), a description of the dispute, and the specific relief sought. The parties will then attempt in good faith to resolve the dispute through informal negotiation for sixty (60) days from the date the notice is received. The applicable statute of limitations and any contractual limitations period (including the one (1) year period in this Section) shall be tolled during this 60-day period. If the dispute is not resolved within 60 days, either party may initiate arbitration in accordance with the procedures below.

Binding Arbitration. Except as expressly carved out below, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your purchase or use of any product — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory — shall be resolved exclusively and finally by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted in Los Angeles County, California, unless the parties agree otherwise or the AAA Consumer Arbitration Rules permit a different location. The arbitrator's decision shall be final and binding, except as provided under "Right to Appeal" below, and may be entered as a judgment in any court of competent jurisdiction.

Arbitrator Selection. The arbitrator shall be selected from AAA's standard consumer roster in accordance with the AAA Consumer Arbitration Rules.

Discovery. Each party shall have the right to obtain discovery sufficient to enable a fair opportunity to present its claims and defenses. The arbitrator shall have the authority to order reasonable discovery consistent with the AAA Consumer Arbitration Rules.

Fees and Costs. The allocation of AAA filing fees, arbitrator fees, and administrative costs shall be governed by the AAA Consumer Arbitration Rules and the AAA Consumer fee schedule then in effect, under which the consumer typically pays a capped filing fee and Laiterie pays the remaining AAA fees and arbitrator compensation.

Right to Appeal. Either party may appeal any arbitration award exceeding USD $50,000 (exclusive of fees, costs, and interest) under AAA's Optional Appellate Arbitration Rules, which are incorporated herein by reference. Any appeal must be filed in accordance with the timelines and procedures set out in those Rules.

Carve-Outs. Notwithstanding the foregoing: (i) Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to protect intellectual property rights or to prevent irreparable harm pending arbitration. (ii) Laiterie may bring any action in court to enforce its intellectual property rights, including any registered or common-law trademark, copyright, trade dress, or trade secret. (iii) Either party may bring a qualifying claim in small claims court in Los Angeles County, California, in lieu of arbitration, provided the dispute remains in small claims court and proceeds only on an individual basis. (iv) Either party may bring an action in court to compel arbitration, to enforce, confirm, vacate, modify, or correct an arbitration award, or otherwise to invoke remedies under the Federal Arbitration Act, 9 U.S.C. §§9–11. (v) Nothing in this Section prevents you from seeking public injunctive relief in a court of competent jurisdiction where required by California law (McGill v. Citibank, N.A., 2 Cal. 5th 945 (2017)). Any claim for public injunctive relief shall be severed from any individual claims, and the individual claims shall remain subject to arbitration.

Class Action Waiver. YOU AND LAITERIE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.

One-Year Limitation. Any claim or cause of action arising out of or relating to these Terms or your use of the Site must be commenced within one (1) year after the claim or cause of action arose, or it shall be forever barred.

Severability of This Section. If any portion of this Section (other than the Class Action Waiver) is found to be unenforceable, the remainder of this Section shall remain in full force and effect. If the Class Action Waiver is found to be unenforceable as to a particular claim or remedy, that claim or remedy (and only that claim or remedy) shall be severed from this Section and proceed in a court of competent jurisdiction, while all other claims and remedies shall remain subject to arbitration.

Termination

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by ceasing to use the Site and notifying us that you no longer wish to use our services.

We may terminate or suspend your access to the Site at any time, without notice, in our sole discretion, including if we determine that you have violated any provision of these Terms. Upon termination, you will remain liable for all amounts due as of the date of termination. Sections 3 (Orders), 7 (Intellectual Property), 8 (User Content and Social Media), 9 (SMS Messaging — as to consent and revocation records), 14 (Disclaimer of Warranties), 15 (Limitation of Liability), 16 (Indemnification), 17 (Dispute Resolution and Arbitration), 18 (Termination), 19 (Force Majeure), and 20 (General Provisions) shall survive any termination of these Terms.

Force Majeure

Laiterie shall not be liable for any failure or delay in performing its obligations under these Terms to the extent such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, earthquake, storm, epidemic, pandemic, war, invasion, terrorism, civil unrest, government orders or restrictions, labor disputes or strikes, cybersecurity incidents affecting third-party providers, internet or telecommunications failures, and failures of third-party carriers, payment processors, or suppliers (each, a "Force Majeure Event"). In the event of a Force Majeure Event, our obligations under these Terms will be suspended for the duration of the event. We will make reasonable efforts to notify you and to resume performance as soon as practicable.

General Provisions

Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.

Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Entire Agreement
